What is an EB-5 VISA? In short it is a U.S. immigrant investor program that provides a path to obtaining a permanent green card for foreign investors and their immediate families. The requirements for a successful application are as follow:

The capital invested must be a minimum of $800,000 - $1,050,000 (depending on location) which must be in cash and all real personal, or mixed tangible assets that is owned and controlled by the candidate, all capital will be valued at fair-market value in U.S. Dollars

Must invest in a new commercial enterprise that was established after 11/29/1990

The business must be for-profit and must be a sole proprietorship, partnership, holding company and its wholly owned subsidiaries, joint venture, corporation, business trust, LLC, or another entity that meets the requirements which may be publicly or privately owned

The business must also create at least 10 fulltime positions for U.S. employees

If the investment is for a business that was established prior to the date above then, the candidate must have purchased the existing business and restructured or organized in a way that results in a new commercial enterprise

The business must have expanded through the investment, which resulted in a minimum of 40% increase of the net worth or the number of employees
